1. Acceptance of Terms
By downloading, accessing, or using the Fashion Sketch Design app ("App"), you agree to be bound by these Terms of Use, which constitute a legally binding agreement (End User License Agreement, "EULA") between you and us. You must agree to these Terms before registering an account or using the App. If you do not agree to these terms, please do not use the App.
2. Description of Service
Fashion Sketch Design is a digital platform that allows users to create, view, share, and interact with fashion sketches and related content.
3. User Accounts
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 13 years of age (or the minimum age required in your jurisdiction) to create an account.
4. User Content
You retain ownership of any sketches, designs, or content you submit ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, publicly display, and distribute your content within the App and related marketing materials.
You are solely responsible for the User Content you create, upload, post, or share through the App.
5. Zero Tolerance for Objectionable Content and Abusive Behavior
We have a zero-tolerance policy for objectionable content and abusive users.
You agree NOT to create, upload, post, share, or transmit any content that:
- Is sexually explicit, pornographic, or contains nudity;
- Depicts violence, gore, or promotes self-harm;
- Is hateful, discriminatory, or harassing toward any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic;
- Is defamatory, threatening, abusive, or intended to intimidate or humiliate others;
- Is illegal, promotes illegal activities, or violates any applicable laws or regulations;
- Infringes on any intellectual property rights, privacy rights, or publicity rights of others;
- Contains spam, malware, or deceptive content;
- Exploits or endangers minors in any way;
- Impersonates any person or entity or misrepresents your affiliation with any person or entity.
Any user who posts objectionable content or engages in abusive behavior toward other users will have such content removed and may have their account suspended or permanently terminated without prior notice and without refund.
6. Content Moderation, Reporting, and Blocking
To keep our community safe, the App provides the following mechanisms:
a. Reporting (Flagging) Content. Users can report/flag any User Content they find objectionable directly within the App. All reports are sent to our moderation team for review. We will review reported content and take appropriate action — including removing the content and/or suspending the offending user — within 24 hours of receiving a report.
b. Blocking Abusive Users. Users can block any other user directly within the App. When you block a user: (i) all content from the blocked user is immediately removed from your feed and will no longer be visible to you; and (ii) our team is automatically notified so we can review the blocked user's content and behavior for potential violations of these Terms.
c. Our Moderation Rights. We actively moderate User Content and reserve the right, at our sole discretion and without prior notice, to remove, edit, or refuse to display any User Content that violates these Terms or that we deem objectionable, and to suspend or terminate the accounts of users responsible for such content.
7. Prohibited Activities
You agree not to:
- Use the App in any unlawful manner;
- Post, upload, or share objectionable content as described in Section 5;
- Harass, abuse, stalk, threaten, or otherwise violate the rights of other users;
- Attempt to hack, manipulate, or disrupt the App's servers or networks;
- Impersonate any person or entity;
- Harvest or collect information about other users without their consent;
- Circumvent or attempt to circumvent any content moderation, reporting, or blocking mechanisms in the App;
- Create multiple accounts to evade a suspension or ban.
8. Termination
We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without prior notice, if you violate these Terms — including, without limitation, any violation of our zero-tolerance policy in Section 5. Upon termination, your right to use the App will immediately cease, and we may remove any of your User Content.
9. Disclaimers and Limitation of Liability
The App is provided "AS IS" without warranties of any kind. We do not guarantee that all User Content will be free of objectionable material, but we are committed to promptly removing such content in accordance with Section 6. We are not liable for any direct, indirect, incidental, or consequential damages resulting from your use or inability to use the App, or from any User Content posted by other users.
10. Changes to Terms
We may modify these Terms at any time. Your continued use of the App following the posting of revised Terms means you accept and agree to the changes. For material changes, we may notify you within the App.
